What Is an OVI?

In Ohio, “OVI” stands for Operating a Vehicle Impaired. This charge applies when someone drives under the influence of alcohol, drugs, or a combination of both, even legal or prescription drugs.

You can be charged with an OVI if:

✔  Your BAC (blood alcohol concentration) is .08% or higher (.02% for drivers under 21)
✔ You fail a field sobriety test
✔ You refuse chemical testing and are deemed impaired by an officer
✔ You are allegedly impaired by marijuana, prescription drugs, or other substances

Common OVI & Traffic FAQs

Refusing a chemical test in Ohio triggers an automatic license suspension under the state’s
“implied consent” law. However, that refusal may also limit the prosecution’s evidence. We can advise you on how refusal impacts your case.

Yes. We may be able to challenge the stop, arrest procedure, or test results. In some cases, charges can be reduced to reckless operation or other lesser offenses.

Possibly. We may request a BMV administrative hearing or apply for limited driving privileges. Timing is critical. Contact us quickly after your arrest.

We understand how important your license is. We’ll work to protect your CDL or help secure limited driving privileges while your case is pending.

It depends on the offense. For example, speeding 11–29 mph over the limit adds 2 points; reckless driving adds 4. Accumulating 12 or more points within 2 years may lead to suspension.
